history: DH & I met in March '73. ah.. to be twenty -something in the springtime.. witnesses to the end of an ugly divisive war....
must have worked like an aphrodisiac......we are looking forward to that release; to breathe easy...is that what it's good for ? war? the relief when it's over- like banging one's head on a wall for no other reason? or self-mutilation? 'cause it feels so good to STOP? Is the current leadership planning to have our kids home before Nov 2008 ?
anyway- cheers to us- 32 years of hangin' in, hangin' on, hangin' out.
turning on, tuning in, & now hooking up.....& we keep on keepin' on;
keep on truckin'.........
btw - our first REAL Spring Day today- a sunny 60!!!!!!!!!
ok- one more thing- I appeared this morning at the Young Municipal Building to report for jury duty and to try to be excused from same.
Lady was so nice- no trials currently- I did not have to stay, but earned my $25 by just showing up. Nice lady said I would not be called again for 12 months.
I will secure a note from Doc- I can not drive to Detroit. DH drove this morning.
(NO RELIABLE, CONVENIENT PUBLIC TRANSPORT here)
so- there I was, stuck downtown for 2 1/2 to 3 hours. So I walked over to the historic landmark-Mariner's Church-a Memorial to all seamen - which I have wanted to visit ever since seeing it the first time we took the tunnel from Fort Pontchartraine de Troit to windsor. I was thrilled to have the time and the weather was dry; the sun came out...perfect. Doors locked. Couldn't get in.
I walked down to Hart Plaza and was the sole visitor at 9am. Later, one jogger came by and another "tourist". We stood at the edge of the river and watched small ice floes move swiftly south. It was a wonderful 1/2 hour. To the right I could just make out the stand still traffic on the Ambassador Bridge- across the river- Windsor. We watched a long, empty ore barge slide down river- to the "Rouge?" There are several wonderful sculptures in Hart Plaza. One is of a group of about 6 former slaves-including 2 small children, standing at river's edge, looking across the river to Canada: a memorial to the People who conducted and used the Underground Railroad.
A quick call to smw and our dearest dtr came by and drove us to Avalon bakery- we had coffee and excellent baked goods. Friends came by and we had a lovely hour or so of Spring-release socializing. Leah R and Joe,soon to be a JD., talked about their plans for the city garden plot. What started as a day of dread turned into a perfect Celebration of Spring.

Sunday was sunny, not terribly cold- high 40's.
Sophia met the Easter Bunny and fell in love; a life sized costumed
version with BIG pink ears toting a basket of hard candies. She wanted to follow the bunny and bunny became the "B - word" -- at any mention of the B word- she was ready to get up and go on the bunny chase. Hopping on cue, Sophia wore lavender.
Brunch was wonderful & smw reminded us to say Grace. Gracia. Grazie.

Me and My Hybrid

DRILLING for oil in the Arctic National Wildlife Refuge is not only an attack on what little remains of this country's wild places; it makes no sense in terms of numbers. We do not know how much oil lies beneath the refuge - at best, it has been estimated, it will fuel our gas-hungry culture for only a few years - but we can easily calculate what a few simple conservation methods would achieve.
Fuel cells and a hydrogen economy being still some way in the future, I recently traded in my Lexus 300 ES sedan for a six-cylinder Honda Accord hybrid. My new car performs as well or better than the previous one, but gives nearly double the mileage for a gallon of gas. Doing a rather average amount of driving in a year - 20,000 or 30,000 miles - I find that I am saving 500 to 1,000 gallons of gas. True, I had to pay a premium for the car (about $3,300 more than the equivalent gas-only model), and my trunk space is a bit reduced, to make room for the battery. But I will make up the extra cost in gas savings in a year or two, I have the convenience of filling my tank only every 500 miles and, more important, I can now drive while enjoying the feeling that I am being economical with fuel and adding half as many pollutants to the atmosphere.
There are some 200 million cars and light trucks on the road in the United States, and if even half of them saved as much fuel as I do now, the total savings would be huge: 50 billion or more gallons of gas a year. This is equivalent to 1.2 billion barrels of oil, about half the entire annual production of oil in the United States and a fifth of what the most reasonable estimates hold can be recovered in total from the Alaska refuge.
There are many ways to save energy, but few are as easy as this. We need to do a great deal more to encourage all kinds of conservation, but especially alternative-energy vehicles, which can contribute enormous oil savings and reduce pollution with no change in lifestyle. Yet the current federal tax incentive for them - a $2,000 deduction this year, and $500 next year - expires entirely by the end of 2006. A first step on the path to a rational energy policy is to reinstate this incentive and increase it.
Other countries have found more creative ways to entice buyers. In Britain, for example, clean vehicles can be exempted from the fee paid by other vehicles to enter congested areas of London during rush hours. Imagine if New York City had a free Green Lane on its bridges and tunnels.
I love the quietness of my hybrid in town, the way the main engine turns off whenever I come to a stop (and this is often in New York City traffic), and there is only the nearly silent electric motor ticking over. I love it when I climb a hill, or have to pass another car, and the electric motor kicks in to assist the gas engine, a bonus of power without any additional fuel demand. And, above all, I love it when, in the city or on the highway, the green ECO sign on the dashboard comes on, and the car is giving me better than 40 miles to the gallon. I know ECO stands for economy, but I like to think it stands for ecology too.

Monday moanin'

Happy Spring Equinox to all.

These days I am busy packing up books and videos and photos -clearing spaces
of non essential (read 'light weight' ) furniture for workmen to come in & re-do the kitchen and floors in 2 rooms.
Original plans had been to relocate entirely, however we lost the opportunity for a good real estate deal, due to my own trepidation of taking on a huge remodeling job on the next property. Now we are dealing with a smaller scale version and postponing an eventual relocation.
The insurance companies call what I am doing "content manipulation",
..... a fantastic euphemism for hauling crap.
The weekend was quiet as we are both suffering from lingering viral infection.
SMW returned from san diego safely & SRW has taken a trip to Vancouver BC-for the first time for a reunion of Yoga classmates.
Sophia went shopping with her Dad yesterday to ' costco' and they cell called us to say hi while in the meat dept. Sophia was chatty.
Our plans for next Sunday- Easter,for some, celebrating the Resurrection of Jesus -and Spring Equinox for others, is to meet the family for brunch. We will likely be cooking a spring lamb or ham dinner at some point next week with asparagus, etc anyway- assuming the cabinets have not yet arrived.
With my sister's passing last August, I am still not in a mood for celebrating much of anything.
We continue to receive good progress reports on JVB in San Fran...Grace brought his Cat in to see him and that seemed to have great beneficial effect.
Monday check- in- phone call from CJS- all is well out there- weather in Kelso, WA not sunny- but not too bad, either. Drought forecast /fear of forest fires. The NW is getting 50% less rainfall than normal.
Rocky needs a trim. We need some sun !

this morning - Rocky was persistent for attention. It happens when DH is paying attention to the cat. Rocky will come to me and not leave, asking for petting and attention. I can not do another thing. He positions himself in a protective manner as if to say- "He is with that "thing" and if that "thing" escapes, I will be here to protect you" ...we need a photo here-
.....our kitchen and family room will be upside down for awhile- so I should really try to get this photo lesson in soon -before they are stashed away for a couple of months.

I have been called for jury duty... to appear March 29th, 8 30 am.
DH will drive me downtown- I don't know how I will get home- maybe Smw will rescue me. Pity pity pity- the lack of public transportation in this town.
It is unbelievable to the car companies & the city , that not everyone owns a vehicle and not everyone can drive the freeways and not everyone has a "driver". City residents - to get to a decent job- leave their homes at 5 am to ride a bus for an hour- out to the 'burbs- to make a little better than 7$/hour.
The example of all successful big cities in the world seems to have eluded this crowd- not to mention the pressure from the "big 3". god forbid we reduce the market in the area for SUV's and trucks. One thing we don't have to worry about around here- is a terrorist attack on our trains- there are none! The level of racism set in place 30+ years ago has worked to ensure suburbanites never need to risk putting foot on ground in the city. Parking lots- oh yes- plenty. Stadiums, oh yes. Easy on easy off freeways-
I am hoping to be able to serve one day for $25.00.

The Church is closing 12 catholic schools in the city. Attendance is an all time low.
Many families outside of the city would have chosen to send their children to a Catholic high school- if only they could get there conveniently- the lack of buses or trains has cost this area in many ways. Well- who am I ? another voice in the wilderness.

People host these and invite the public in gratitude for answered prayers.
Traditional southern Italian dishes are served- meatless.
Pasta with a squid sauce. Scrambled eggs with asparagus. Sphingi- a doughnut-like sweet covered in powdered sugar.

tuesday 3/15 the Ides of March

ON THIS DAY
On March 15, 1965, addressing a joint session of Congress, President Johnson called for new legislation to guarantee every American's right to vote.

I believe 'ides' means the middle of the month.
if I am wrong- pls correct.
so- I have gone mouse-less for about a week.
fyi- Logitech- maker of cordless mice- sent a Free replacement- might be worth it to you to find one.
Today DH went to the office and I am about to get into a horizontal position. DH brought home, from Knoxville TN, some strange bug causing cough, aches and no appetite.
Updates: cabinets on order. 8 boxes, so far, of photos,videos, books, kitchen non essentials packed...some have gone to the basement- some sitting in dining room and some still in the kitchen. I don't think we have any more useless items than the next household- they are just sort of spread out more. With the fibromyalgia I have set up the kitchen to reduce repetitive difficult movements. Our kitchen lady has arranged for the dishwasher to be higher off the ground- reducing awkward to the floor bending to the lower shelf
and installing one cabinet lower than the rest- which we have - as DH built one for me, but the new will have drawers and new counter top. Soon we will have to order dishwasher, range hood & cabinet pulls.
SMW is visiting SRW in san diego this week. Prep for Sophia's birthday party is topic of discussion. April 16th. We'll have the honor of Sophia's maternal Great grandmother's presence. She prefers to be called 'GiGi'.
Several driving trips in the offing- but I don't think I can do it this year.
I may save myself for a visit to so california later in the year and possibly Colorado for Conference in October. At this moment nothing seems do-able- but it will pass. DH needed 3 whole days to recover.
I am really missing my sister and my friend jvb, who is making slow progress. the good news is currently he will not be relocated to Texas....thanks to a good friend who has made legal arrangements.
Soon I will ask my dear niece to help me figure out how to put photos here- a blog with no photos seems terribly unexciting.........

failed. There has been no raise in 8 years.

Arlen Specter was kept from voting by the Pres. He was in PA w/him at the time of the Kennedy vote and says he would have voted for it- which means other junior republicans may have crossed over with his lead. Shifty POTUS.

Rocky: is driving me crazy. I bought 2 rawhide whatever they are called-
chew toys ? Anyway - he is so demanding of my attention, I am constantly interrupted
to 'play' and 'pet'. This morning I had to give him one to keep him occupied: like a human toddler- if I sit at the pc- he seems to think I am free to pay attention to him.
DH walks him every day. DH is out of town. We are proud guardians of a beautiful,smart Lab/chow; keeping a dog like this is time consuming, energy draining.
Xena, feline resident, doesn't mind 1/2 as much if she is ignored. At least she let's herself out now with the slightly warmer temps.

...at this minute the Senate is voting on a minimum wage amendment to the
bankruptcy bill. Kennedy Amendment would raise minimum wage from
5.15 to 7.25 over a period of 26 months-
The amendment requires 60 aye votes to pass.

Interestingly the time factors coincide with 18 mos) 2006 senate elections and the(26 mos. 2008 >national was this just a dog and pony show ?

Loves to dance and twirl. we do 'yoga' positions including
palms up in sitting position. Does her puzzles in record time and
immediately flips them over to do again.
When asked her age- says "5". Helped me set the table for dinner.
Tells us where to sit. Won't keep a barrette in her hair.
Draws crayon circles & lines at every opportunity on any, every available surface.
Helps me up off the floor after "Ring around the rosy"
DH: is visiting Knoxville TN for 5 days.
smw: will fly out on saturday for visit to srw and san diego.
Initial deposit placed for kitchen overhaul.

At a Suit's Core: Are Bloggers Reporters, Too?
By JONATHAN GLATER
In the physical world, being labeled a journalist may confer little prestige and may even evoke some contempt. But being a journalist can also confer certain privileges, like the right to keep sources confidential. And for that reason many bloggers, a scrappy legion of online commentators and pundits, would like to be considered reporters, too.
A lawsuit filed in California by Apple Computer is drawing the courts into that question: who should be considered a journalist?
The case, which involves company secrets that Apple says were disclosed on several Web sites, is being closely followed in the world of online commentators, but it could have broad implications for journalists working for traditional news organizations as well.
If the court, in Santa Clara County, rules that bloggers are journalists, the privilege of keeping news sources confidential will be applied to a large new group of people, perhaps to the point that it may be hard for courts in the future to countenance its extension to anyone.
"It's very serious stuff," said Brad Friedman, who describes himself as an investigative blogger (his site is bradblog.com). "Are they bloggers because they only publish online? I think you have to look at what folks are doing. And if they're reporting, then they're reporters."
Apple has long had a devoted following, and leaked information about new Apple products has appeared on Web sites for years. To combat this, the company filed the suit late last year against the sources of these leaks - people the company assumes are employees or contractors.
Apple has asked the court to compel the Web sites that displayed the product information to disclose their identity. Bloggers are fighting Apple's efforts, which it has focused on three Web sites - Thinksecret.com, Appleinsider.com and PowerPage.org.
The judge in the case, James Kleinberg, is required only to interpret a California statute that recognizes a privilege protecting reporters in keeping news sources confidential. A ruling could come as early as this week.
On its face, the lawsuit brought by Apple has to do with theft of trade secrets. But Susan Crawford, a law professor at Cardozo law school of Yeshiva University (and a blogger herself), says that the steps Apple has asked the court to take open a broader question.
"Under what circumstances should an online forum be forced to disclose a source behind information that they're posting?" Ms. Crawford said. "There is no principled distinction between a New York Times reporter and a blogger for these purposes. Both operate as news sources for wide swaths of the general public."
Blogs, she added, are already becoming more and more powerful, and some have readerships that exceed those of small-town newspapers. "We've seen it with Rather being brought down by bloggers," she said, referring to the CBS news anchor, who came under intense scrutiny by bloggers after a "60 Minutes Wednesday" segment on President Bush's National Guard service was broadcast .
Judge Kleinberg is likely to try to decide the case on the narrowest possible grounds, perhaps reading the text of the California law at issue to cover only people who work for traditional newspapers and magazines or television news programs, and to avoid deciding if bloggers are indeed journalists, Ms. Crawford said.
Whatever the judge's decision, it is all but certain to be appealed. But the question of who is a journalist is to many a matter of deeper concern.
Some bloggers want any protection available to journalists at traditional media companies to also be available to them, and journalists at those companies want to make sure that the reporter shield privilege is preserved.
Yet if recognizing a privilege for bloggers means that everyone online can maintain that they are journalists, judges may conclude that rather than giving everyone the privilege, no one should have it. That possibility worries reporters, who could find themselves at new risk for what they write or broadcast.
Apple has not sued the Web sites for damages for publishing the trade secrets, but it could try, said Eugene Volokh, a law professor at U.C.L.A. He is considering filing a friend-of-the-court brief in the case on the side of the bloggers, saying that the privilege should extend to them.
"This turns out to be an unresolved question of First Amendment law," Mr. Volokh said, referring to the issue of liability for the Web sites.
Attempting to draw a distinction based on the medium used by the blogger or reporter is misguided, said Jack Balkin, a professor at Yale Law School (also a blogger). "In 15 years, there may be no clear distinction between reporters on the one hand and bloggers on the other," he said. "It won't just be an either-or, where you have a reporter for The Chicago Tribune on the one hand, and a guy sitting in his pajamas drinking beer on the other."
Not all blogs are equally influential and not all blogs even try to report, in the usual sense of cultivating sources, actively gathering information and then organizing and presenting it to the public, Mr. Balkin added. "There are millions and millions of blogs, and most of them are for gossip."
Many states have privilege statutes like the one in California, and others may consider enacting them. To determine who should be able to claim any kind of privilege against disclosing news sources, he said, courts and lawmakers should look at exactly what the would-be reporter does.
"It should be extended on a functional basis," he said. So a blogger who interviews people and spends significant amounts of time gathering and organizing information could claim the privilege; a blogger who wrote about good and bad recipes, and who one day stumbled onto a copy of the Pentagon papers and printed them, might not.
Such a functional definition could prove elastic, and an enterprising blogger would have every reason to assert any available privilege. Mr. Balkin - asked whether he would assert the privilege if a former student leaked information to him about a Supreme Court justice that then appeared on his Web site - did not hesitate to claim it for himself.
"I would be willing to claim that if you look in my blog, what I'm doing is so similar to what Lewis or Krugman or Safire do," he said, referring to Anthony Lewis, Paul Krugman and William Safire, current and former columnists for The Times, that "although it's done more informally and it's about a much narrower area, that I could claim that I was in the functional definition. That's what happens when you start taking a functional approach."
Mr. Friedman, the blogger, said that ultimately, bloggers' role as purveyors of important information that traditional news organizations might ignore made online journalists more important than before, and so more deserving of protection.
"As the mainstream media has become more and more corporate and more and more like the governmental and corporate bodies that mainstream journalists used to report on," he said, "a lot of this stuff has fallen now to the bloggers - to do what mainstream folks used to do. It's still serving the exact same purpose: keeping the bad guys honest."

72 years ago...

He remains on a feeding tube, will begin physical therapy soon
and is able with effort to say some words.
We don't have any authenticated information as the 'family' is
not sharing with friends. Brain fissure has been mentioned.
Research says there is hope for independent recovery in about 3 months.
A few of Jb's friends are going to court to block action that may jeopardize
jb's rent controlled apartment in the city. Anyone who pays rent in CA knows how important this is.
Kitchen: cabinets have been ordered. Maple with a "wheat" stain.

This is very exciting for us- if you cannot imagine what this will look like- we understand- it is very difficult to put this sort of thing together unless you are watching HGTV 24/7 -
Visiting Sophia tomorrow.
Little Gizmo - one of 2, 15/yo dogs who have lived next door for about 11 of those years- passed from heart failure last night. He is being buried in the yard- right next to our fence. Won't be planting vegetables there. We don't mind.
I like the idea of a private cemetery.

Channel 4 San Diego

SRW in San Diego was chosen to be on channel 4 in
San Diego for a news item on Bikram Yoga.
The story will air in April. Some of footage is of a class.
SRW was asked to demonstrate, solo.
Going to check to see if we can get a stream- and will post here if
that will work. the Star will be touring
in april- to sign autographs.
